The Yogi government’s decision of admitting students to AYUSH undergraduate courses on the basis of NEET exams has been quashed by the Allahabad High Court. The UP Government had decided to admit students to AYUSH courses in different state colleges through a merit list prepared on the basis of NEET exam for admissions to medical courses. AYUSH courses include courses like Naturopathy, Yoga, Unani, Siddha, Homeopathy and Ayurveda. However, the Lucknow bench of the court on Tuesday directed the state government to conduct a Common Entrance Test for admissions in Ayush courses and further directed it to complete the admission process by 30 September, 2017.

The Petitioners including Amit Kumar et. al., had challenged the Yogi government’s order that students for AYUSH course for academic session 2017-18 would be taken on the basis of the merit list of the NEET (National Eligibility Cum Entrance Test).
The High Court directing State government
Justice D.K. Upadhyaya: “In view of the aforesaid discussions, it is apparently clear that the State Government while taking the impugned decision has not taken into account various relevant factors which makes the impugned decision vulnerable and not in conformity with the requirement of constitutional principles of reasonableness and fairness in the State actions enunciated under Article 14 of the Constitution of India. Further, the impugned decision has clearly resulted in depriving the petitioners and various other like candidates/students from exercising their right to participate in selection for admission to various AYUSH Under Graduate Courses.” The bench has laid out directions for conducting a common entrance test for admissions to the AYUSH courses, the process of which should be completed by September 30.
