Uttarakhand HC stays Lower PCS recruitment process amid reservation challenge


DEHRADUN: The Uttarakhand high court (HC) issued a stay on Wednesday on the recruitment process for the Lower Provincial Civil Services (PCS) to fill 190 positions and directed the state government to respond to the matter within three weeks. The court’s decision came in response to a petition challenging the commission’s choice to surrender six posts reserved for candidates with disabilities. The next hearing on the matter has been scheduled for August 9.
The Uttarakhand Public Service Commission (UKPSC) had advertised the vacancies for 190 Lower PCS posts in August 2021. The preliminary examination was conducted in December 2021, followed by the final examination on August 22, 2022. Interviews for successful candidates in the final examination were scheduled to commence on July 24.
The petitioner, Vinod Singh, has requested the court to cancel the commission’s decision to surrender six posts reserved for Divyang (persons with disabilities). According to the petitioner, “this action by the commission is unconstitutional as the UKPSC is merely an agency and does not have the authority to surrender any posts to the government that have already been designated”.
Furthermore, the petitioner argued that “if the recruitment process proceeds without considering the reservation for candidates with disabilities, it would cause irreparable harm to them, as they would become overage for the next recruitment process”.
The court ruled that the recruitment process would be on hold until the government files its affidavit in response.
