JEE Advanced 2023: SC dismisses plea against 75% eligibility criteria


NEW DELHI: The Supreme Court on Monday dismissed a plea challenging the 75 per cent eligibility criteria in the higher secondary examination (12th) for admission to the Indian Institute of Technology (IITs).
The petition was filed by Chandan Kumar and others challenging the eligibility criteria of 75 per cent marks in 12th board exams for admission to IITs.
During the hearing, justices Sudhanshu Dhulia and K.V. Viswanathan declined to intervene into the matter citing that the due process has already been followed in this case. Also, the bench pointed out that the matter is related to education and “not something we want to get into.”
The prosecutor representing the petitioners argued that the students who have scored above 90 percentile in JEE Mains 2023 and have qualified for Advanced will not get a chance to get selected for admission into IITs if they have scored lesser than 75 per cent. The counsel also emphasised that these students are meritorious and urged the court to allow them.
“We find no reason to entertain this petition under Article 32 of the Constitution of India. The writ petition is dismissed accordingly. Pending application(s) stands disposed of,” said the bench in its order.
